Family Abuse Protection Act (FAPA) Protective Order
You may be eligible to apply for this protective order if you meet the following eligibility requirements:
Age
You (the "Petitioner") and the person you're seeking protection from (the "Respondent") must both be at least 18 years old.
Relationship
You and the Respondent must have at least one of the following relationships with each other:
- Current or former spouse or Registered Domestic Partner or
- Live with (or used to) each other in a sexually intimate relationship or
- Have a sexually intimate relationship (or did within the past 2 years) or
- Related to each other by blood, marriage, or adoption or
- Parents of a child together
Abuse
Within the last 180 days (note, there are exceptions to this timeframe) the Respondent must have done at least one of the following:
- Physically injured you or
- Tried to physically injure you or
- Caused you to feel afraid that they were about to physically injure you or
- Made you have sexual relations against your wishes by using force or threats of force
Ongoing Danger
You must be in ongoing danger of abuse very soon. The respondent must be a threat to the physical safety of you or your children
